What is international arbitration?

International arbitration is a dispute resolution method where parties submit their disputes to arbitrators who issue a final decision. It offers confidentiality, speed, and the ability to choose arbitrators with specific expertise. Arbitral awards are enforceable internationally and are commonly used in cross-border commercial disputes, international investments, and other cases requiring a neutral resolution.

Defence in International Arbitration Courts

With extensive experience in international arbitration, we represent our clients in jurisdictions and courts around the world. Our lawyers are familiar with international legal frameworks and regulations, including in Latin America, the United States, and the United Kingdom, among others. We provide legal solutions tailored to each situation, achieving the best possible outcome regardless of the jurisdiction.

Some of the arbitration institutions where we operate include the Madrid International Arbitration Centre, the Spanish Court of Arbitration, the Court of Arbitration of Madrid, the Civil and Mercantile Arbitration Court and ICAM Arbitration Court.

Types of arbitrations and sectors

At Ayuela Jiménez, we offer arbitration services using tailored strategies for each case. Our experience covers multiple sectors, including construction, engineering and infrastructure, renewable energy, commercial, investment, sports, raw materials supply, post-M&A (mergers and acquisitions), and statutory or corporate, among others.

Our work across these diverse sectors allows us to understand the specifics and challenges of each one, providing robust and specialised representation at all times. Our client base includes Spanish companies with interests abroad and international corporations seeking advice on their European-based arbitrations.

Highlighted international arbitration cases

Arbitration before the International Arbitration Centre of Madrid (CIAM)

In this complex litigation at the International Arbitration Centre of Madrid (CIAM), we represented the claimant in a post-contractual competition case. We defended our client against a counterclaim challenging the validity of a non-compete clause and alleging contractual breaches.

Arbitration before the International Chamber of Commerce (ICC)

We represented a respondent before the International Chamber of Commerce (ICC) in a case related to the delivery of photovoltaic material. The dispute involved “rebus sic stantibus” and defects in consent. We defended our client by demonstrating that the contractual conditions had not changed and that there were no defects in consent.

FAQs

How does the international arbitration process work?

In international arbitration, the parties involved in the dispute select their arbitrators and agree on a procedure to resolve the dispute. The process includes the presentation of evidence, hearings, and the issuance of an arbitral award.

What happens if a party does not comply with the arbitral award?

If a party does not voluntarily comply with the arbitral award, the other party can request its enforcement through the courts. These will review the award and may issue measures to ensure compliance.

How long does international arbitration typically take?

The duration of international arbitration depends on the complexity of the case and the agreed procedure. However, this method of dispute resolution is usually faster than traditional litigation.

How does the place of arbitration affect my case?

The place of arbitration affects the applicable law, the arbitration procedure, and the potential for appeal. The seat should be chosen carefully to ensure a neutral environment, which is why it is essential to have expert advice on the matter.
